A longtime Papa John’s general manager (31 years with the company) was rear-ended in a serious crash on July 12, 2020—hard enough to total his car—and developed ongoing neck, shoulder, and knee problems. Although he didn’t go to the ER the day of the wreck, he saw his primary care doctor a few days later, was referred to orthopedics, completed physical therapy, and received six injections in 2020 (plus an additional injection later). His total medical bills were $18,740, and his treating doctor testified that his ongoing and future treatment needs were caused by the collision.
Despite returning to work, the client said his knee increasingly gave out, making it harder to do his job and contributing to him eventually leaving Papa John’s and taking a lower-paying position. The defense pointed to pre-existing issues and other life circumstances, but the jury credited the injury story and future-care plan.
Before trial, the insurance company’s offer (which was his insurance company) was $25,000. After a three-day trial, the jury awarded $313,740 for the client’s injuries and loss of enjoyment of life. The insurance company thought our client wouldn’t try his case and the jury wouldn’t believe him. They were wrong. We help people in this same situation everyday.
